Mabank couple charged in death of nine-month-old girl
MABANK–Two arrests have been made in the April death of a nine-month-old female baby in Mabank.
The incident occurred April 18 at 108 North 11th Street in Mabank. Investigator Billy Snell responded to a call at approximately 12 p.m. on a deceased person.
Investigator Snell arrived and was directed by officers to an apartment. Once inside the apartment, Snell observed a nine-month-old female infant laying on the floor deceased. Snell spoke with parents Tony Louis Guerra and Davina Day Rogers, who had custody and possession of the victim.
The child was transported to Southwestern Institute of Forensic Science in Dallas for an autopsy to determine the infant’s cause of death.
Investigator Snell received the toxicology reports June 16. That report determined that the infant died from a lethal dose of oxymorphone and oxycodone in her blood system.
Snell believes that both Guerra and Rogers intentionally and knowingly caused the victim serious bodily injury that resulted in the child’s death.
Investigator Snell was granted arrest warrants for both Guerra and Rogers by Kaufman County’s 86th District Court Judge Casey Blair June 22. Both are charged with injury to a child, elderly individual or disabled individual, which is a first-degree felony. If convicted, the charge is punishable by a maximum sentence of 99 years or life in prison and/or a maximum fine of $10,000.
Guerra and Rogers were both arrested June 24 by the Mabank Police Department and transported to the Kaufman County Sheriff’s Office and booked on the previous charge. The couple’s bonds are set at $500,000 each.
