Rogers sentenced to 20 years in death of nine-month-old

MABANK–Davina Day Rogers, 32, of Mabank was sentenced to 20 years in the Texas Department of Corrections in relation to the death of her nine-month-old daughter’s death.
Rogers went to trial Sept. 13 with 86th District Court Judge Casey Blair presiding. Rogers faced charges of reckless injury to a child causing serious bodily injury or mental deficiency. Tony Luis Guerra, 33, who is the father, is awaiting trial for the same charge.
April 18, 2020, Mabank police responded to a call at 108 North 11th Street in Mabank. Investigator Billy Snell responded to the call at approximately 12 p.m. for a deceased person. Snell arrived and was directed by officers to an apartment. Once inside the apartment, Snell observed a nine-month-old female infant laying on the floor deceased. Snell spoke with the parents, Guerra and Rogers who had custody and possession of the victim.
The child was transported to Southwestern Institute of Forensic Science in Dallas for an autopsy where it was discovered that lethal amounts of oxymorphone and oxycodone were in her system. Guerra and Rogers were both arrested June 24 by the Mabank Police Department and transported to the Kaufman County Sherriff’s Office and booked on the charges of injury to a child, elderly individual and remained at the jail on $500,000 bonds each.
According to Kaufman County records, Rogers filed motion for a new trial and notice of appeal Sept. 20.
